Did you know that Publix Super Markets in Florida now permits customers to openly carry firearms in its stores?
Following a September 25, 2025 ruling by Florida’s First District Court of Appeal in the case stems from McDaniels v. State of Florida, initiated by Second Amendment activist Stanley Victor McDaniels, who deliberately challenged the law in 2022 by openly carrying a firearm.
That court issued a ruling that the state’s ban on open carry unconstitutional. Publix Super Markets has confirmed it is complying with the new state law, stating that it follows all federal, state, and local regulations, while emphasizing that any customer creating a threatening, erratic, or dangerous shopping experience—regardless of firearm possession—will prompt store management to engage local law enforcement.
The policy change applies to all Publix stores across Florida, with multiple employees and store managers confirming the shift in practice. However, Publix has not issued a blanket ban on open carry but maintains the right to ask individuals to leave if their behavior is deemed threatening.
While Publix allows open carry, other retailers like Walmart, Target, Sam’s Club, and Winn-Dixie continue to prohibit firearms in their stores.
