According to Florida Governmental Utility Authority, State regulations require a setback zone for all Public Water Supply Wells.
From time to time, proposed development includes facilities that encroach into that setback zone, examples would be fuel storage tanks or Sewer Septic Tanks.
In the case of the 7-Eleven project, buried fuel tanks were proposed within the setback zone of one of FGUA’s wells. It is FGUA policy not to allow such encroachments.
However, final decisions rest with the Department of Health in consultation with the Florida Department of Environmental Protection and there is a variance process that can be pursued by a developer for those situations.
