
A woman being served a “Notice to Appear” document by law enforcement was unlawfully taken into custody by deputies.
Stephanie Garner was asleep in her Lehigh Acres home when she and her husband heard a knock on the door just before 3 a.m., she explained.
Deputies announced themselves and told Garner they had a warrant for her arrest.
Garner followed the orders of law enforcement and went with them to the jail in downtown Fort Myers.
Once she got to the jail, Garner said she heard deputies confused about the incident, asking questions, and then calling her “unarrestable.”
Garner later learned she was supposed to be served a Notice to Appear in court on a probation violation for a DUI arrest in December 2015.
Representatives from the Lee County Sheriff’s Office said they were made aware of the incident when it occurred, calling it a miscommunication after recent policy changes on warrant documentation.
The agency said the incident was documented as it is required. They have no record of an inquiring from Garner for an internal affairs investigation into what happened.
Garner said she is looking to a law suit against the Lee County Sheriff’s Office.
