Attorney Threatens Local Media

It’s funny when people do not like the truth and try to use attorney’s to bully their cause.

This attorney also has been bullying other local media outlets all day.

The Lehigh Acres Gazette received this email from Kristian Dunn from Dunn & Miller in Tallassee that represented Modern Midways in the 2013 Ring of Fire case.

 

To the Lehigh Acres Gazette

I am Kris Dunn from the law firm of Dunn & Miller, P.A., the attorneys for Modern Midways, Inc., the operators of the amusement rides that were in Lehigh Acres. I have represented Modern Midways, Inc., since 2013 and I find it distressing that you mention some grave inconsistencies in the report. Namely you state in your headline about my client being “responsible again.” This is headline is libelous because it states that my client was found at fault in a prior incident. That is not true. Secondly, you imply that my client was at fault for what occurred with the Ring of Fire ride in 2013 and you reference an investigation. I will have you know that my client was not found at fault by the Department of Agriculture and Consumer Services, which monitors and disciplines ride operators throughout the state. The results of the investigation were disputed by my client and we had hired the ride’s designer and manufacturer to appear as expert witnesses, if need be, for any courtroom activities. When the Department saw the other side of the story, they agreed that my client was not at fault, thus controverting their own investigation. I would appreciate it if you made these corrections to the story. Please do not contact my client anymore and relay all communications through me.

Question: Isn’t the ride operator / owner responsible for all maintenance and operation of those rides and games? The Attorney would not answer that question.

Who is Midwest Midways and what relationship does it have with Modern Midways?

What happen in 2003 at the Lehigh Acres Spring Festival, 2005 Lehigh Acres Spring Festival, 2005 in Highland Indiana, 2013 – 2015 at the Lehigh Acres Spring Festival?

According to documents from the Florida Department of Agriculture that over sees rides – between 2011 and 2013, state inspectors recorded deficiencies at 23 different locations, as Modern Midways traveled across the state.

So far there has been virtually no comment for the Lehigh Acres Spring Festival Committee – Except for “We do not run the rides the operator does”.
