Did you know with so many recent hurricanes, many Floridians learned when their trees caused damage to other homes and property, the current no fault laws covered the damage, but now a new bill in the Florida legislature is about to change that?<\/p>\n\n\n\n

Florida is currently considering a bill known as the “Fallen Tree Act” (SB 724 and HB 599) that would change the responsibility for fallen trees. Under this act, the owner of the property where a tree is rooted would be liable for any damage caused by that tree or its branches to neighboring properties. This means that if a tree from your property falls and damages your neighbor’s property, you would be responsible for the damages.<\/p>\n\n\n\n

The bill also allows property owners to remove trees or shrubs growing on shared property lines without needing permission from their neighbors, as long as they provide 30 days’ written notice. This provision is intended to address situations where a tree poses a risk to a neighbor’s property.<\/p>\n\n\n\n

However, the bill does not apply to properties larger than five acres. Additionally, if a tree is healthy and falls due to natural causes, the current owner of the tree is not responsible for the damage. If the tree is diseased and the owner was aware of the issue, they could be held responsible.<\/p>\n\n\n\n

The bill aims to protect property owners from bearing the burden of responsibility when they suffer damage to their property caused by trees or shrubs located on neighboring property. If approved by the legislature and signed by Governor DeSantis, the new law would take effect on July 1, 2025.<\/p>\n","protected":false},"excerpt":{"rendered":"
