But Tremblay’s attorney now argues there’s no proof she was behind the wheel.<\/p>\n\n\n\n
\u201cIs there anything within the PC or booking report that puts her behind the wheel?” The judge asked in court today<\/p>\n\n\n\n
The state argued that witnesses place Tremblay behind the wheel at the time of the crash when an ATV driver was hit and seriously injured. Witnesses say Tremblay then left the area and was involved in a second crash on Bell Blvd.<\/p>\n\n\n\n
\u201cWitnesses say they saw the woman in the pink bikini step out of the challenger and began yelling and screaming. But they don\u2019t say they see her get out of the driver’s seat,” said Tremblay’s attorney Aaron O’Brien.<\/p>\n\n\n\n
O’Brien also argued against charges of reckless driving.<\/p>\n\n\n\n
\u201cThere is no evidence of reckless driving the witnesses say the vehicles collided. Speed alone is usually not enough for reckless driving. And here I would say it\u2019s not, there\u2019s no speed limit. There are no marked lanes.\u201d<\/p>\n\n\n\n
The state responded, saying given that the crash took place in a recreational area with children and ATV’s present, her driving should be considered reckless.<\/p>\n\n\n\n
\u201cGiven the type of area it is, it\u2019s a recreational area a lot of children and ATVs would be reckless for the environment she\u2019s in.\u201d<\/p>\n\n\n\n
Tremblay’s attorney disputes the charges from the second scene, claiming that Tremblay was a passenger. He argued that only the driver is required to stay on the scene of a crash.<\/p>\n\n\n\n
Wednesday, the judge gave the state 24 hours to provide proof that Tremblay was behind the wheel.<\/p>\n","protected":false},"excerpt":{"rendered":"
