{"id":46681,"date":"2020-05-08T00:26:05","date_gmt":"2020-05-08T04:26:05","guid":{"rendered":"https:\/\/thelehighacresgazette.com\/news\/?p=46681"},"modified":"2020-05-08T00:26:12","modified_gmt":"2020-05-08T04:26:12","slug":"judge-signals-support-for-restoring-fl-voting-rights-of-former-felons","status":"publish","type":"post","link":"https:\/\/thelehighacresgazette.com\/news\/2020\/05\/judge-signals-support-for-restoring-fl-voting-rights-of-former-felons\/","title":{"rendered":"Judge Signals Support for Restoring FL Voting Rights of Former Felons"},"content":{"rendered":"\n<p>A federal judge has signaled he&#8217;ll find part of a&nbsp;<a href=\"http:\/\/www.flsenate.gov\/Committees\/billsummaries\/2019\/html\/2038\" target=\"_blank\" rel=\"noreferrer noopener\">Florida law<\/a>&nbsp;restricting the voting rights of people with felony records unconstitutional.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"2560\" height=\"1344\" src=\"https:\/\/i0.wp.com\/thelehighacresgazette.com\/news\/wp-content\/uploads\/2020\/05\/636531029577406310-Bradshaw-Trial5-scaled.jpg?fit=1024%2C538&amp;ssl=1\" alt=\"\" class=\"wp-image-46682\" srcset=\"https:\/\/thelehighacresgazette.com\/news\/wp-content\/uploads\/2020\/05\/636531029577406310-Bradshaw-Trial5-scaled.jpg 2560w, https:\/\/thelehighacresgazette.com\/news\/wp-content\/uploads\/2020\/05\/636531029577406310-Bradshaw-Trial5-300x158.jpg 300w, https:\/\/thelehighacresgazette.com\/news\/wp-content\/uploads\/2020\/05\/636531029577406310-Bradshaw-Trial5-1024x538.jpg 1024w, https:\/\/thelehighacresgazette.com\/news\/wp-content\/uploads\/2020\/05\/636531029577406310-Bradshaw-Trial5-768x403.jpg 768w, https:\/\/thelehighacresgazette.com\/news\/wp-content\/uploads\/2020\/05\/636531029577406310-Bradshaw-Trial5-1536x806.jpg 1536w, https:\/\/thelehighacresgazette.com\/news\/wp-content\/uploads\/2020\/05\/636531029577406310-Bradshaw-Trial5-2048x1075.jpg 2048w\" sizes=\"(max-width: 2560px) 100vw, 2560px\" \/><\/figure>\n\n\n\n<p>At the end of the trial Wednesday, U.S. District Judge Robert Hinkle made it clear he intends to rule that Florida cannot force a person convicted of a felony to pay outstanding court debts in order to be eligible to vote.<\/p>\n\n\n\n<p>Nancy Abudu, deputy legal director of the Southern Poverty Law Center, which challenged the law, says it amounts to an illegal poll tax that the state wasn&#8217;t even prepared to enforce.<\/p>\n\n\n\n<p>&#8220;This was a disorganized, convoluted, confusing system that the state was ill-equipped to implement or enforce in any effective way,&#8221; she states.<\/p>\n\n\n\n<p>The State of Florida identified some 85,000 registered voters who might be ineligible to vote, despite the passage of Amendment Four, which ended the state&#8217;s lifetime ban on voting for most people with felony convictions.<\/p>\n\n\n\n<p>The state acknowledged in court that it has yet to determine which voters have outstanding debts that would violate the new law.<\/p>\n\n\n\n<p>Abudu says part of the Southern Poverty Law Center&#8217;s claim focused on the intersection of race, class and gender of the estimated 774,000 people who were disenfranchised.<\/p>\n\n\n\n<p>&#8220;We presented to the court facts &#8212; such as, you know, people with a criminal conviction have an unemployment rate that&#8217;s five times higher than the general population &#8212; that over 40% of black women who have had a criminal conviction are unemployed,&#8221; she states.<\/p>\n\n\n\n<p>Lawyers for the state maintained that voters who approved Amendment Four wanted people with felony convictions to pay their debt to society fully before having voting rights restored.<\/p>\n\n\n\n<p>Now, hundreds of thousands are awaiting a ruling that could allow them to participate in the upcoming presidential election.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A federal judge has signaled he&#8217;ll find part of a&nbsp;Florida law&nbsp;restricting the voting rights of people with felony records unconstitutional.
