Did you know that Marijuana legalization activists in Florida have submitted a new initiative to legalize recreational marijuana again, this time for a ballot vote in 2026?

The group, Smart & Safe Florida filed a proposal to legalize recreational Marijuana with the state Division of Elections on January 15, 2025. This new measure addresses some of the concerns raised in the previous ballot measure that failed to garner the required 60% supermajority in the November 2024 election. Key provisions of the new initiative include allowing adults aged 21 and older to possess, purchase, or use marijuana for non-medical consumption, establishing possession limits, prohibiting marketing and packaging attractive to children, and maintaining a ban on smoking and vaping in public places.

The group Smart & Safe Florida is a conglomerate of businesses, investment companies and others that would benefit from the sale of recreational Marijuana. One of the largest contributions to the 2024 failure of the recreational pot use-failure were the corporations who would financially enrich themselves if the initiative were to pass.There is a high probability that the same would occur in 2026.

Governor DeSantis recently called a special legislatives session that could put a damper in the effort to have the new initiative on the 2026 ballot. He has asked the legislature to take on several areas that he believes are important for the state including addressing illegal Immigrants, but also proposed changes in Florida laws regarding the current process for gathering and submitting petitions to get proposed constitutional amendments on the ballot.
